NOTICE OF HEARING TO IMPOSE AND PROVIDE FOR COLLECTION OF SPECIAL ASSESSMENTS

Notice is hereby given that the City of Marathon, Florida, will conduct a public hearing to consider the imposition of special assessments against certain parcels of property located in the City. The hearing will be held at 5:30 p.m., or as soon thereafter as the matter can be heard, on August 14, 2018 at the City of Marathon Council Chambers, 9805 Overseas Highway, Marathon, Florida, for the purpose of receiving public comment on the proposed Assessment Area and assessments. In accordance with the Americans with Disabilities Act, if you are a person with a disability who needs any accommodation in order to participate in this proceeding, you are entitled, at no cost to you, to the provision of certain assistance. Please contact the City at (305) 289-4130, at least five days prior to the public hearing. All affected property owners have a right to appear at the hearing and to file written objections with the City within 20 days of this notice. If a person wishes to appeal any decision made by the City Council with respect to any matter considered at the hearing, such person will need a record of the proceedings and may need to ensure that a verbatim record is made, including the testimony and evidence upon which the appeal is to be made.

The assessments have been proposed to fund the on-going maintenance of stormwater collection and treatment facilities. The assessment for each parcel of property will be based, in part, on the number of equivalent residential units attributable to such parcel. The maximum annual assessment is estimated to be $120.00 per ERU. A more specific description is set forth in the Preliminary Assessment Resolution adopted by the City Council on July 27, 2010. Copies of the Preliminary Assessment Resolution and the preliminary Assessment Roll are available for inspection at the offices of the City Manager, located at 9805 Overseas Highway, Marathon, Florida.

The assessments will be collected on the non-ad valorem tax bill, as authorized by Section 197.3632, Florida Statutes. Failure to pay the assessments will cause a tax certificate to be issued against the property which many result in a loss of title. The hearing will be held at 5:30 p.m., or as soon thereafter as the matter can be heard, on August 14, 2018 at the City of Marathon Council Chambers, 9805 Overseas Highway, Marathon, Florida for the purpose of receiving public comment on the assessments and their collection on the tax bill. The Assessments were originally imposed in 2008, 2009, and 2011 to fund construction of wastewater collection and treatment facilities. The assessment for each parcel of property is based, in part, on the number of equivalent dwelling units attributable to such parcel, and, in part, on the number of connections attributable to such parcel. Unless prepaid, the annual assessment will include your share of the principal, interest and collection cost. The maximum annual assessment is estimated to be $415 per EDU and $93 per Connection for Service Areas 1, 3, 4, 5, 6 & 7, and Little Venice is levied at $308.82 per connection. A more specific description is set forth in the Initial Assessment Resolution adopted by the City Council on June 24, 2008 and June 9, 2009. Copies of the Initial Assessment Resolution, the plans and specifications for the wastewater collection and treatment facilities, and the preliminary Assessment Roll are available for inspection at the offices of the City Manager, located at 9805 Overseas Highway, Marathon, Florida.

The assessments will be collected on the ad valorem tax bill, as authorized by Section 197.3632, Florida Statutes. Failure to pay the assessments will cause a tax certificate to be issued against the property which may result in a loss of title. The City Council intends to collect the assessments in not to exceed twenty (20) annual assessments, the first of which was included on the ad valorem tax bill mailed in November 2009. Future annual assessments may be prepaid at the option of the property owner.

Environmental Public Meeting Notice

The Restoration Advisory Board (RAB) of Naval Air Station Key West invites local community members to their annual meeting to discuss the environmental status and cleanup activities at the Air Station. The meeting will be held on July 25, 2018 at 6 p.m. in the Meeting Room of the Florida Keys Eco-Discovery Center, 35 East Quay Road, Key West, FL 33040. The RAB is composed of community members and representatives of the Navy, State and Federal Regulatory Agencies. Technical experts on the environmental program at the Air Station will be present at that time to address any concerns regarding specific cleanup activities. Community members are welcome to engage in an informal question and answer session following the business portion of the RAB meeting. Free parking is available at the Eco-Discovery Center for attendees’ convenience. Facility Location:  The applicant operates the existing Charles A. Russell Generation Facility, which is located in Monroe County at 3421 Overseas Highway (U.S. 1), Marathon, Florida.

Project:  The applicant owns and operates the existing Charles A. Russell Generation Facility, which is an electric utility. The existing facility consists of of eight existing non-emergency engines, two emergency diesel powered engine/generators, and two emergency propane fired engine/generators.

The applicant applied on June 14, 2018 to the Department for a Title V air operation permit revision to delete emission Unit No. EU010, a propane fired 30 kW (30 HP) Emergency Generator and replace it with new Emission Unit No. EU014, propane fired 20 kW (30 HP) Emergency Generator. The new generator is a (RICE) SI engine that is regulated by rule 40 CFR63 Subparts ZZZZ and JJJJ. This is a revision to Title V Air Operation Permit No. 0870004-008-AV.

Permitting Authority:  Applications for Title V air operation permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210, and 62-213 of the Florida Administrative Code (F.A.C.).  The proposed project is not exempt from air permitting requirements and a Title V air operation permit is required to operate the facility.  The South District Office is the Permitting Authority responsible for making a permit determination for this project.  The Permitting Authority’s physical address is:  D.E.P South District, 2295 Victoria Avenue, Suite 364, Fort Myers, Florida 33902.  The Permitting Authority’s mailing address is: D.E.P. Project File:  A complete project file is available for public inspection during the normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday (except legal holidays), at the address indicated above for the Permitting Authority.  The complete project file includes the draft permit, the Statement of Basis, the application, and the information submitted by the applicant, exclusive of confidential records under Section 403.111, F.S.  Interested persons may view the draft/proposed permit by visiting the following website:  fldep.dep.state.fl.us/air/emission/apds/default.asp and entering the permit number shown above.  Interested persons may contact the Permitting Authority’s project review engineer for additional information at the address or phone number listed above.

Notice of Intent to Issue Permit:  The Permitting Authority gives notice of its intent to issue a revised Title V air operation permit to the applicant for the project described above.  The applicant has provided reasonable assurance that continued operation of the existing equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C.  The Permitting Authority will issue a final permit in accordance with the conditions of the draft/proposed permit unless a response received in accordance with the following procedures results in a different decision or a significant change of terms or conditions.

Comments:  The Permitting Authority will accept written comments concerning the draft/proposed Title V air operation permit for a period of 30 days from the date of publication of the Public Notice.  Written comments must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the Permitting Authority at the above address.  As part of his or her comments, any person may also request that the Permitting Authority hold a public meeting on this permitting action.  If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida Administrative Register (FAR).  If a public meeting is requested within the 30-day comment period and conducted by the Permitting Authority, any oral and written comments received during the public meeting will also be considered by the Permitting Authority.  If timely received written comments or comments received at a public meeting result in a significant change to the draft permit, the Permitting Authority shall issue a revised draft/proposed permit and require, if applicable, another Public Notice.  All comments filed will be made available for public inspection.  For additional information, contact the Permitting Authority at the above address or phone number.

Petitions:  A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S.  Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first.  Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication.  A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing.  A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 32399-3000, Agency_Clerk@floridadep.gov before the deadline.  The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it.  Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C.

A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information:  (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address, any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact.  If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action.  A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit.  Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.

Mediation:  Mediation is not available in this proceeding.

EPA Review:  EPA has agreed to treat the draft/proposed Title V air operation permit as a proposed Title V air operation permit and to perform its 45-day review provided by the law and regulations concurrently with the public comment period, provided that the applicant also transmits an electronic copy of the required proof of publication directly to EPA at the following email addresses:  R4TitleVFL@epa.gov.  Although EPA’s 45-day review period will be performed concurrently with the public comment period, the deadline for submitting a citizen petition to object to the EPA Administrator will be determined as if EPA’s 45-day review period is performed after the public comment period has ended.  The final Title V air operation permit will be issued after the conclusion of the 45-day EPA review period so long as no adverse comments are received that result in a different decision or significant change of terms or conditions.  The status regarding EPA’s 45–day review of this project and the deadline for submitting a citizen petition can be found at the following website address:  www2.epa.gov/caa-permitting/florida-proposed-title-v-permits.

Objections:  Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(2), any person may petition the Administrator of the EPA within 60 days of the expiration of the Administrator’s 45-day review period as established at 42 U.S.C. Section 7661d(b)(1), to object to the issuance of any Title V air operation permit.  Any petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day public comment period provided in the Public Notice, unless the petitioner demonstrates to the Administrator of the EPA that it was impracticable to raise such objections within the comment period or unless the grounds for such objection arose after the comment period.  Filing of a petition with the Administrator of the EPA does not stay the effective date of any permit properly issued pursuant to the provisions of Chapter 62-213, F.A.C.  Petitions filed with the Administrator of EPA must meet the requirements of 42 U.S.C. DEPARTMENT OF ENVIRONMENTAL PROTECTION
NOTICE OF INTENT
The Department of Environmental Protection hereby provides Notice of Intent to Issue a permit for the proposed project, subject to the conditions specified in the draft permit and summarized below. The applicant, Key Largo Wastewater Treatment District, Jered Primicerio, Operations Manager, 103355 Overseas Highway, Key Largo, Florida 33037 applied on November 21, 2017, for a permit to operate a Class I injection well. The project is located at the Key Largo Wastewater Treatment District, 103355 Overseas Highway, Key Largo, Florida 33037 in Monroe County (File No. 272762-006- UO/1M, WACS ID No. 97750).

The facility will operate: A non-hazardous underground injection controlwell system, consisting of one Class I injection well and one dual-zone monitor well, at the Key Largo Wastewater Treatment Facility (WWTF). Injection well IW-1 is constructed with a 16-inch diameter fiberglass reinforced plastic (FRP) casing to 2,735 feet below land surface (bls) and a total depth of 3,604 feet bls. Injection is into the Oldsmar Formation for the disposal of secondary treated municipal effluent which has received high level disinfection from the WWTF. The maximum disposal rate is 4,520 gallons per minute (GPM) and the maximum disposal volume is 6.5 million gallons per day (MGD). The dual-zone monitor well MW-1 is completed from 1,460 to 1,494 feet bls and from 1,650 to 1,702 feet bls.

The Department has permitting jurisdiction under Chapter 403 of the Florida Statutes (F.S.) and the rules adopted thereunder. The project is not exempt from permitting procedures. The Department has determined that an operation permit is required for the proposed work.

The Department will issue the permit unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S., before the deadline for filing a petition. On the filing of a timely and sufficient petition, this action will not be final and effective until further order of the Department. Because the administrative hearing process is designed to formulate final agency action, the hearing process may result in a modification of the agency action or even denial of the application.

A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S., Pursuant to Rules 28-106.201 and 28-106.301, Florida Administrative Code (F.A.C.), a petition for an administrative hearing must contain the following information:

  1. The name and address of each agency affected and each agency’s file or identification number, if known;
  2. The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination;
  3. A statement of when and how the petitioner received notice of the agency decision;
  4. A statement of all disputed issues of material fact. If there are none, the petition must so indicate;
  5. A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action;
  6. A statement of the specific rules or statutes that the petitioner contends require reversal or modification of the agency’s proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and
  7. A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

The petition must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us. Also, a copy of the petition shall be mailed to the applicant at the address indicated above at the time of filing.

In accordance with Rule 62-110.106(3), F.A.C., petitions for an administrative hearing by the applicant and persons entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of receipt of this written notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the notice or within 14 days of receipt of the written notice, whichever occurs first. The failure to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C.

Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.

Mediation is not available in this proceeding.

Once this decision becomes final, any party to this action has the right to seek judicial review pursuant to Section 120.68, F.S., by filing a Notice of Appeal pursuant to Florida Rules of Appellate Procedure 9.110 and 9.190 with the Clerk of the Department in the Office of General Counsel (Station #35, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000) and by filing a copy of the Notice of Appeal accompanied by the applicable filing fees with the appropriate district court of appeal. The notice must be filed within 30 days from the date this action is filed with the Clerk of the Department.

NOTICE OF DRAFT PERMIT

The Department of Environmental Protection hereby provides Notice that it has prepared the Draft Permit for the proposed project as detailed in the application, subject to the conditions specified in the Draft Permit and summarized below. The applicant, Elite Sky International South Florida, Inc., Mr. Chen Ting Yee, President, 205 Garden Avenue, Brooklyn, New York, 11237 applied on February 26, 2018 for a permit to construct two Class V injection wells. The project is located at 1100 Overseas Highway, Marathon, Florida, 33050, in Monroe County (File No. 0361709-001-002- UC/5X, WACS ID No. 105167).

The facility will construct two non-hazardous Class V injection wells (IW-1 and IW-2) for the disposal of live lobster holding tank water from the Elite Sky International South Florida, Inc. lobster transfer facility. The maximum injection volume for IW-1 and IW-2, combined, shall be 0.072 million gallons per day. The injection wells will be constructed with a 6-inch diameter casing set to 60 feet below land surface (bls), with a total depth of 90 feet bls.

The Department has permitting jurisdiction under Chapter 403 of the Florida Statutes and the rules adopted thereunder. The project is not exempt from permitting procedures. The Department has determined that a construction permit is required for the proposed work.

Any interested person may submit written comments on the draft permit and may request a public meeting within 30 days after publication of this public notice. A request for a public meeting shall be submitted in writing and shall state the nature of the issues proposed to be raised in the meeting. If a public meeting is later scheduled, there will be another 30-day notice period for that meeting. Written comments or a public meeting request shall be submitted to the Department of Environmental Protection, Aquifer Protection Program, 2600 Blair Stone Road, MS 3530, Tallahassee, Florida 32399-2400, which is the office processing this permit application. All comments received within the 30-day period will be considered in formulation of the Department’s final decision regarding permit issuance.

On January 13, 2018, at or near Stock Island, Florida, duly authorized officers seized approximately 6,173 pounds of shrimp from the F/V RONALD E for violation of federal law, including the Magnuson Stevens Fishery Conservation and Management Act.

The seized property, being perishable, was sold for $6,173.40, the proceeds of which are subject to forfeiture to the United States under 16 U.S.C. § 1860(a), and are being held by NOAA.

Notice is hereby given that NOAA is commencing forfeiture proceedings against the above-described property.

Any person claiming an interest in the above described property must file a claim within 30 days after the date of final publication of this notice. Said claim must be filed with the Office of General Counsel, Enforcement Section, 263 13th Avenue South, St. Petersburg, FL 33701. Such claim must be received by the above office on or before April 2, 2018, (30 days following the date the final Notice is published in accordance with 15 C.F.R. 904.504).
